TERMS AND CONDITIONS

When booking Santa Hank (“Performer”), Client agrees to these Terms and Conditions upon payment of any required retainer or full fee. These Terms apply to all appearances including private parties, corporate events, retail appearances, photo sessions, parades, nonprofit events, and home visits.

DEFINITIONS

This Agreement is between Santa Hank – Event Character Services (“Performer”) and Client, including Client’s principals, agents, employees, contractors, guests, and representatives. Client represents they have the authority to enter into this Agreement.

Performer operates as an independent contractor.

“Appearance” means the scheduled time period in which Performer provides costumed holiday character services.

“Media” includes photographs, video, recordings, livestreams, or promotional materials created during the Appearance.

BOOKING & PAYMENT TERMS

Unless otherwise stated in writing:

• A 30% non-refundable retainer is required to reserve the date
• Remaining balance is due at the time of service-discreetly
• Home visits and short appearances must be paid in full at time of service
• Travel fees may apply and will be outlined in the invoice

No Appearance is confirmed until retainer is received.

Time is of the essence.

CANCELLATIONS & RESCHEDULING

Client cancellations the retainer will be a credited for future/rescheduled events.

Reschedules may be allowed once, at Performer’s discretion, if notice is provided at least 72 hours prior to the event and subject to availability. Retainers may not be refunded, Retainers will be credited to client’s account for future events.

If Client fails to appear or cancels after Performer has arrived at the location, Client is responsible for the full balance- rescheduling available at the entertainer’s discretion.

PERFORMANCE STANDARDS

Performer agrees to appear in professional costume, remain in character, and interact with guests in a friendly, family-appropriate manner.

Performer retains artistic and character discretion and may decline any unsafe, unlawful, inappropriate, or uncomfortable requests.

CLIENT RESPONSIBILITIES

Client agrees to provide:

• A safe, clean, climate-controlled environment
• Adequate breaks for appearances over one hour
• Access to restrooms and a private area for breaks or changing
• A sturdy, appropriate chair (not too low) for seated visits
• Crowd control when necessary
• Safe parking and unloading access

Client is responsible for guest conduct and agrees to prevent harassment, rough handling, or unsafe behavior toward Performer.

SAFETY & RIGHT TO TERMINATE

Performer reserves the right to immediately terminate the Appearance if:

• Conditions are unsafe
• Guests are intoxicated or abusive
• The environment is excessively hot
• Weapons, illegal activity, or harassment are present
• Performer is touched inappropriately
• Costume integrity is at risk

In such cases, no refunds will be issued.

MEDIA & RECORDINGS

Client and guests may take photos and video for personal, non-commercial use only unless otherwise agreed in writing.

Commercial use, advertising, resale, or branding use requires written permission.

Performer may capture behind-the-scenes or promotional media unless Client opts out in writing.

LIABILITY & INDEMNIFICATION

Client assumes all responsibility for the event premises.

Client agrees to indemnify and hold harmless Performer from any claims, injuries, losses, damages, or legal costs arising from the event, guests, or venue.

Performer is not liable for consequential or incidental damages.

Performer’s total liability shall not exceed the amount paid under this Agreement.

FORCE MAJEURE / FAILURE TO PERFORM

If Performer cannot appear due to illness, accident, severe weather, mechanical failure, or other circumstances beyond reasonable control, Performer will:

• Attempt to secure a comparable replacement performer, or
• Refund all fees paid

This shall be Client’s sole remedy.

KILL FEE / CLIENT NON-USE

If Performer arrives and performs professionally but Client elects not to use the services or ends the event early, Client remains responsible for the full contracted amount.

LOCATION & PERMITS

Client is responsible for:

• Securing venue permission
• Required permits
• Parking arrangements
• Indoor backup for outdoor events if weather is severe

Performer will not trespass or violate venue rules.

NON-ASSIGNMENT

Client may not transfer this Agreement without written consent.

ACCEPTANCE & ELECTRONIC SIGNATURES

Electronic signatures, booking forms, and payment receipts constitute acceptance.

Placing a retainer or using services confirms agreement to all Terms herein.

GOVERNING LAW

This Agreement shall be governed by the laws of the State of Oklahoma.

Client agrees to venue and jurisdiction in Oklahoma courts and to pay reasonable attorney’s fees if Performer must enforce this Agreement.

SEVERABILITY

If any provision is deemed unenforceable, remaining provisions remain valid.

ENTIRE AGREEMENT

These Terms and Conditions represent the full agreement between Performer and Client and supersede all prior communications, whether written or oral.
